CHICAGO — Six Rosati’s Pizza franchisees must pay $250,000 in unpaid wages and damages to restaurant and delivery workers who aren’t receiving overtime pay.
A federal court has awarded the operators of six Rosati’s Pizza franchises in Illinois and Indiana $250,000 to recover unpaid overtime for 35 restaurant and delivery workers, according to the U.S. Department of Labor. I demanded payment of unpaid wages and damages.
On Wednesday, April 19, a federal judge issued an order against Rosati’s pizzeria owners Karpesh Patel and Ketan “Kevin” Limbativa. bloomingdale, mattson, plain field and richmond, illinois; and Dyer, Indianato pay unpaid wages and damages in three payments.
Investigators found that Patel and Limbachiva had incorrectly classified the delivery drivers as independent contractors, even though store managers were in control of their time and assigned tasks.
They also accused Patel and Limbachiva of failing to pay some workers overtime on time, failing to pay half the normal wage rate for hours worked in excess of 40 hours per week; of employees were misclassified as exempt from overtime and failed to maintain proper payroll records. .
